An attempt by the Chris Giwa-led faction of the Nigerian Football Federation to commit the immediate past Chairman of the NFF, Alhaji Aminu Maigari and the Secretary-General, Musa Amadu to prison for contempt suffered a setback in Jos on Wednesday as a Federal High Court in Jos ruled that the prayers of the Giwa faction did not take cognisance of the proceedings in the present suit.

Obinna Ogba and Yahaya Adamu of the Giwa-led faction sued Maigari and Amadu seeking to commit them to prison or a warrant for arrest for disobeying court orders which barred them from conducting a fresh congress of the NFF, which produced Mr. Amaju Pinnick as the new NFF president, said that order for substituted service did not cover the current process.

But Justice Ambrose Allagoa, ruling on application by Ogba and Adamu, said that the earlier application which the plaintiffs brought asking for an order of substitution did not apply in the current circumstances.

He therefore asked them to choose the option of serving the defendants personally or approaching the court for a new order to serve them by substituted service. He said that somebody cannot be committed to court in his absence, adding that what the plaintiffs should have sought was an order to compel the defendants to appear in court.

He therefore adjourned the case until October 23 when he is expected to continue with the case.
