Witness recounts how four plots of land was sold in WAEC land dispute

A defence witness, Dr Rotimi Olulana has narrated to a Lagos High Court sitting in Ikeja how a disputed acres of land situated at plot 6, Southern Industrial Estate, Agidingbi Ikeja, was sold to West African Examination Council (WAEC) for N250 million.

Olulana stated this in his testimony before Justice M.O Emeya at the hearing of a suit filed by, Mr.Kayode Euzibio against Maxi Market Limited (1st defendant), the Attorney General of Lagos State (2nd defendant), the West African Examination Council (WAEC) (3rd defendant) and the Registrar of titles, Lagos state (4th defendant) respectively over the land in dispute.

While he was cross-examined by the claimant counsel, Babatunde Oshilaja, the witness informed the court that as an agent he was given Power of Attorney to sell the land to WAEC International.

In his evidence, he told the court that he was not aware of a consent judgment delivered by Justice Samuel Candide-Johnson which directed Maxi Market limited and the claimant (Euzebio) to jointly carry out the sales of the land.

He also admitted that the Deed of Assignment issued for the sales of the disputed land did not bear the name and signature of the claimant as directed by the consent judgment.

Olulana further testified that the owners of the land had tried to recover the land from the Lagos State government without success but that he was able to recover it for them within eleven years.

The claimant contended that pursuant to terms of a settlement dated October 27, 2008 parties in the suit agreed to a joint sale of the disputed land.

He stated that the consent judgment of Justice Samuel Candide-Johnson, the company (Maxi Market limited) was obliged to carry out the sales of the land jointly with him (Euzebio).

The claimant alleged that the company sold the land to West WAEC International against the terms of judgment and deposited the sum of N25 million into his account without his consent.
