A former governorship aspirant in Delta state, Hon. Victor Ochei, on behalf of his firm, DavNotch International Company has raised a contempt charge against the former chairman of the Peoples Democratic Party (PDP), in the state, Senator Peter Nwaoboshi at an Asaba High Court.

Ochei, who was one time speaker of the state house of assembly is praying the court to commit Nwaoboshi to Prison for allegedly violating the orders of the court, which ordered that status quo be maintained by parties in a disputed land, pending the hearing and determination of motion on notice.

As a result, the plaintiff through his counsel, Sola Rhiogbere has raised form 48, which is a notice of consequences of disobedience of court orders, dated August 11 and form 49, notice to show cause why order of commital should not be made against the respondent, dated August 16.

Justice F. Azinge had restrained parties from accessing the parcel of land in dispute between DavNotch and Nwaoboshi pending the determination of the substantive suit. But the plaintiff alleged that the respondents violated the order by continuing with contruction on the disputed site.
The plaintiff had in suit No A/104/2016 accused Nwaoboshi of trespassing on his land, a claim which he denied.The plaintiff had alleged that in May this year, some persons believed to be agents of Nwaoboshi, forcefully broke into the company’s land, measuring 4019.440 square meters and began construction on the land.

He further averred that the ownership of the land is incontestable as available authenticated documents showed that the Davnotch owns the land situated at plot 37, Core Area, Central Spine, Phase IV, Asaba.

This, he said, is covered by Certificate of Occupancy, No. DTSR 14767 issued in 2010, approved by the then state governor and signed by then commissioner for Lands, Raymos Guanah,on behalf of the governor.

“It was registered as No. 47 on page 47 in volume Co 186 of the office of the Lands Registry in Asaba with relevant details of payment for the land,” he claimed.Hearing in the case has been fixed for October 12, 2016.
