Justice Ademola Adeniyi of the Federal High Court in Abuja, yesterday, disqualified himself from entertaining two separate suits that were filed against President Goodluck Jonathan by a sacked Judge of the high court, Justice Gladys Olotu.

Aside Jonathan, Olotu also sued the Chief Justice of Nigeria, the National Judicial Council, NJC, the Attorney General of the Federation and the Chief Judge of the Federal High Court.

The plaintiff who was on February 27, ordered to vacate her office after the NJC found her guilty of judicial misconduct, is seeking for a reversal of the decision which she said was in breach of her fundamental human rights.

Besides, she equally sought an order restraining the Economic and Financial Crimes Commission, EFCC, the Independent Corrupt Practices and Other Related Offences Commission, ICPC, and the Inspector-General of Police from investigating or arresting her over allegations bothering on corruption.

Meantime, Justice Ademola yesterday withdrew from the matter, saying he would return the case file to the Chief for reassignment to another Judge.

Counsel to the NJC, Mr. Phillips Jimoh-Lasisi, SAN, had earlier alleged bias against the Judge.

Jimoh-Lasisi noted that Justice Ademola had also dragged the NJC to court, insisting that his ability to objectively handle Olotu’s case was in doubt.

He argued that the NJC had in its preliminary objection, challenged the jurisdiction of the court to hear the cases.

He therefore contended that the right thing to do was for the judge to disqualify himself from Olotu’s case since the issue in contention was similar to his own matter against the NJC.

Likewise, counsel to President Jonathan and the AGF, Dr. Soni Ajala also supported the stance of the NJC and urged Justice Ademola to disqualify himself.

Ruling on the matter, Justice Ademola held that in view of the arguments by the defendants, he was left with no option than to return the case file for reassignment.

In his own suit marked: FHC/ABJ/CS/689/2014, Justice Adeniyi is also seeking to restrain the NJC from further investigating a petition against him.

The case is currently pending before Justice Abdulkadir Abdulkafarati of the same high court.

On her part, Justice Olotu who was sacked under the immediate past CJN, Justice Mariam Aloma Muhktar, applied for judicial review of her removal from office by President Jonathan following the recommendation of the NJC.
