A suit challenging the selection of Mr. Seyi Makinde as the Social Democratic Party, SDP, gubernatorial candidate for Oyo State was yesterday stalled at the Federal High Court in Ibadan.

Messrs Oluwagbemiga Boyede and Rasak Adegboyega, both SDP members, had instituted the legal action.

Also joined in the suit are the SDP and the Independent National Electoral Commission, INEC.

The plaintiffs had claimed that Makinde did not participate in the party’s governorship primary election conducted on December 6, in which Mr. Samson Aworinde emerged the flag bearer.

At the resumed hearing of the suit, Justice Ayo Emmanuel adjourned the suit following the failure of plaintiffs’ counsel, Mr A. Adeloye, to serve a counter-affidavit on the defence.

Adeloye had confirmed being served an application by Seyi Makinde dated Feb. 23, challenging the jurisdiction of the court to hear the matter.

According to him, a counter-affidavit dated Feb. 25 was filed on March 6.

Messrs Yakub Fadare, T.P. Iyanda and Omoniyi Fayanju, counsel to Makinde, SDP and INEC, respectively, had told the court that they had not been served the counter-affidavit.

Consequently, the judge ordered the plaintiffs’ counsel to provide the defence with the counter-affidavit urgently to enable them to reply.

He then adjourned the case till March 10.
