Osighala, who spoke with journalists on Monday, described as false and misleading reports that the interim injunction restraining the coronation ceremony to fill the stool had been vacated.

Justice O.O. Ogungbesan of a Lagos State High Court, in Ikeja, had on August 14 restrained the Lagos State Governor, Akinwunmi Ambode, or anyone acting under his authority from going ahead to crown Chief Kabiru Shotebi  as the new Ayangburen of Ikorodu Kingdom.

The judge also restrained Shotebi from either “presenting himself for coronation” or “parading himself as the Ayangburen of Ikorodu, or actualising any recognition thereon as such, or exercising any of the Ayangburen royal functions,” pending the determination of a suit filed by one Odupitan Eniola, from the Lambo branch of the Lasunwon chieftaincy family of Ikorodu Kingdom.

The claimant counsel, Osighala, while reacting to a report that the restraining order had been vacated, explained, “What happened at the last adjourned date was that all the parties agreed to vacate the next hearing date, which was 26th of August to October 6 and to transfer the case file to Ikorodu.

“The judge did not deal with the application to set aside the ex parte order. As of the last adjourned date, the respondents just served us with application to set aside the ex parte order and we needed time to respond.

“In any event, the application to set aside will come before the substantive judge because, don’t forget, Justice Olabisi Odugbesan, who made the order, was a vacation judge.”

The lawyer added that Form 48, Notice of Consequences of Disobedience of Court Order, had already been filed against all those that allegedly participated in flouting the order, and that he was in the process of effecting service of Form 49, committal application, on the alleged contemnors.

Besides, Osighala disclosed that he has forwarded a letter to the Chief Judge of Lagos State, Justice Oluwafunmilayo Atilade, asking that Justice Michael Salvage of Ikorodu division should not be allowed to handle the matter.

He said the request was predicated on the ground that the said judge had delivered judgment in a sister case, and may be biased in handling the instant case.
