A FederaL High Court sitting in Lagos, has adjourned till March 10 for further hearing in the suit by impeached Speaker of Ekiti State House of Assembly, Adewale Omirin and others, challenging the legality of their impeachment.

Omirin, is a member of the All Progressives Congress, APC, was impeached by seven lawmakers of the Peoples Democratic Party, PDP in the state. He is in court with 18 other APC lawmakers, challenging their impeachment and other steps taken by the PDP lawmakers.

At the resumed hearing in the matter, counsel to the APC lawmakers, Mr Norrison Quakers, SAN, told the trial judge, Justice Saliu Seidu that they have had difficulties serving the court processes on the state governor, Ayo Fayose and other defendants owing to the security of their lives.

Norrison suggested an undertaken by the lawyers to the defendants that their clients be served through them.

But the position was opposed by counsel to the defendants, who insisted that the order of court as to service of the processes must be complied with.

The matter was subsequently adjourned till March 10, 2015 for mention.

The impeached Speaker, his Deputy, Adetunji Orisalade, and 17 APC members of the House of Assembly are plaintiffs in the case.

The defendants include Dele Olugbemi, Samuel Ajibola, Adeojo Alexander, Adeloye Adeyinka, Israel Olowo Ajiboye, Fatunbi Olajide and Olayinka Abeni.

Others are the Inspector General of Police, Suleiman Abba Commissioner of Police, Ekiti State, Mr. Owoseni Ajayi, Mr. Kayode Oso, and Chief Toyin Ojo. Omirin and others are praying the court to restrain Odugbemi and Abeni from parading themselves or otherwise acting in the capacity of Speaker and Deputy Speaker, respectively of the Ekiti State House of Assembly as same was illegal, unconstitutional and ultra vires.

The applicants are also seeking an order of interim injunction restraining the 1st-7th defendants, whether by themselves or their agencies /privies, from illegally carrying out legislative functions to wit, making laws or transacting business as legislators of the Ekiti State House of Assembly, pending the hearing and determination of the motion on notice.
