A High Court in Lugbe, FCT, has fixed Dec. 15 for definite hearing in a suit filed by Andikan Resources Limited against FCT Minister and two others over alleged unlawful demolition of its estate. Justice Angela Otaluka fixed the date following the absence of the respondents and their lawyers in court on Thursday.

Other respondents to the case are the Federal Capital Development Authority and the Inspector-General of Police (I-GP). Otaluka ordered that the notice of new date of hearing should be served on all the defendants. Andikan Resources Limited had alleged that the respondents demolished the estate located at Sabon Lugbe South-West extension layout, in 2012 without notice.

The company alleged that the land was duly allocated to it by the Abuja Municipal Area Council (AMAC) and built over 80 housing units of various specifications and sizes on it. The plaintiff said the Presidency had intervened and set up a committee headed by a Commissioner of Police, James Aroniyo, to investigate the matter.

The company said that the committee demanded for the original document of the land for sighting and investigation which was given to it. Andikans alleged that after sighting, the committee collected the original document and refused to release it. It alleged that the I-GP also refused to comply with the subpoena from the court to come and tender the document as exhibit.

At the resumed hearing of the case, lawyer to the plaintiff, Mr Alex Williams, reminded the judge of its subsisting order of subpoena on the I-GP. Williams said his client will begin a contempt proceeding on the I-GP if he failed to comply with the court’s order at the next adjourned date.
