THE Court of Appeal sitting in Owerri, Imo State capital, Thursday struck out the two suits filed by the impeached deputy governor of Imo State, Sir Jude Agbaso, pursuant to his struggle to upturn his sack from office.

Agbaso, in suit number CA/OW/187/2013, challenged the ruling of the lower court, where he pleaded lack of fair hearing by the ad-hoc committee set up by Imo State House of Assembly.

Similarly, Agbaso also prayed the Court of Appeal in suit number CA/OW/291/2013, to upturn the decision of Justice Nonye Okoronkwo, who ordered that witnesses be called to enable him determine whether Agbaso was duly served by the impeachment panel or not.

Delivering the lead judgment in the first suit, Justice Itta G. Mbabbah, ruled that records of proceeding and some of the accompanying exhibits showed that the appellant willingly submitted himself for questioning by the ad-hoc committee of the State Assembly that probed his alleged malfeasance.

The court declared that the office of the President, Vice President, governor, deputy governor, minister or any other office, did not confer any fundamental right on the person occupying it and therefore struck out the appeal.

Delivering the lead judgment in the second suit, Justice Peter Ige, ruled that Justice Okoronkwo played safe in wanting to get at the truth of the issues raised in affidavits deposed by the parties in the matter.

“Justice Okoronkwo did not abdicate his responsibility or power when he called for witnesses to unravel the truth. The appellant did not state that the trial judge did not use his discretion as stipulated by law, to call for witnesses”, Ige said.
