A Lagos High Court in Ikeja has dismissed the N50 million charge brought against the Executive Director, Lagos International Trade Fair Complex Management Board, LITFCMB, Mr. Bassey Eyamba, by the Economic and Financial Crimes Commission, EFCC.
Eyamba, alongside Okafor Eunice, Francis Dajilak, Okocha Lazarus and Kolo Barnabas, were arraigned by the agency in 2013 on a 20-count charge bordering on conspiracy to steal and stealing of over N50 million.
Justice Kudirat Jose dismissed the charge, following a preliminary objection by the defence counsel, Mr. John Kalu, who asked the court for an order to strike out the charge for want of jurisdiction on the ground that it was premature, an abuse of court process, incompetent and ultra vires to the powers of the EFCC.
The defence counsel further sought the court for an order for N500 million compensation for the unlawful detention and malicious prosecution of the defendants.
Meanwhile, the commi-ssion had on March 4 filed a notice to discontinue the criminal proceedings.
Attached to the notice, brought pursuant to Section 172 of the Administration of Criminal Justice Law No 11, Laws of Lagos State, 2011, was an eight-paragraph affidavit and a letter to discontinue by the Attorney General of the Federation, Bello Adoke (SAN).
