An Onitsha Magistrate’s Court, yesterday, ordered the Standard Organization of Nigeria, SON, to return all plants or machines that it removed from the factory of Bendusco International Agency Limited.

Delivering judgment in a case filed by SON against the company, presiding Chief Magistrate M. N. O. Okonkwo, said SON’s action was far above the scope of the order his court gave on September 3.

According to him, “I am constrained to make an order and it is hereby ordered that all plants and/or machinery that are uprooted or removed from the factory of the defendant by the plaintiff or its agents/privies be restored back to the factory by the plaintiff as the act of removal of the machines is far above the scope of our order of September 3.

“SON’s execution of the same order in Kano and Lagos, if it is true, contrary to the specific places it mentioned in Anambra State, is a clear case of illegality, as the order is concise and clear on its scope of jurisdiction.

“It is necessary for me to remark that the said order of court was to be executed at the premises of the defendant located at R2/667 Main Market Onitsha, K15 Onitsha Owerri Road, Obosi, 2 Nwaziki Street, Awada Obosi, or any other places in Onitsha Town or environ.

“The execution of the said order in Kano or Lagos, if it is true, is a clear case of illegality as the order is concise and clear on its scope of jurisdiction.”

SON had, in a suit filed in the Magistrate’s Court of Anambra State, Onitsha Magisterial District, asked the court to grant an order for it to enter, search, inspect, take samples, seize, seal and compel the respondent and other owners of shops, stores, warehouse and other premises or storage facilities located at R2/667 Main Market, Onitsha, KM15 Onitsha Owerri Road, Obosi.

Other areas it sought the court order was to carry out search, inspect, take samples, seize, seal, and other activities, at 2 Nwaziki Street, Awada Obosi or any other premises in Onitsha and environs to comply with standards of shaving stick and allied products and other sub-standard products found in the said stores, warehouse, storage facilities, vessels, and vehicles.
