After eight years of legal battle, the Owerri Division of the Court of Appeal has awarded N603.180 million against construction giant, Julius Berger Plc, as damages and compensation for the treatment of Mrs. Philomena Ugo, who had a collision with the company’s truck.

In a lead judgment delivered by Raphael Chikwe Agbo, the court ordered the company to pay N603,180,560 million and 150,000 Indian Rupees as general damages against the company and the cost of Mrs Ugo’s treatments in Nigeria and abroad.

In a unanimous judgment by Justice Peter Olabisi Ige, Justice Frederick Oho and Justice Agbo, the appellate court held that Mrs Ugo’s counsel, Mr. Emeka Ozoani, had proved his appeal and the cross appeal in the case.

The court held: “It seems to have been established by judicial authority that in personal injury cases, two main factors have to be taken into consideration in assessing damages in cases of liability.

“These are financial loss resulting from the injury and the personal injury involving not only pain and suffering, but also the loss of pleasures of life.”
